This privacy policy explains which personal data we process when you visit our website or contact us, for what purposes and on what legal basis we do so, and what rights you have. We use terms such as “personal data”, “processing” or “controller” within the meaning of Art. 4 of the General Data Protection Regulation (GDPR).
You can use our website without providing any information about yourself; in that case, only the technically necessary access data is processed (section 4). We do not use any analytics, advertising or tracking services and we do not create user profiles.
The controller responsible for data processing on this website within the meaning of the GDPR is:
G.A. Neeb GmbH & Co. KG, Linderhauser Str. 77-79, 42279 Wuppertal, Germany
Personally liable partner: Gustav-Adolf Neeb-Verwaltungs GmbH, represented by its managing director Gustav A. Neeb. Further information about our company can be found in our legal notice.
If you have any questions about data protection or wish to exercise your rights, you can contact us at any time using the contact details above.
We only process personal data where a legal basis permits us to do so. The following are particularly relevant:
Where information is stored on, or read from, your device (e.g. cookies), § 25 of the German Telecommunications Digital Services Data Protection Act (TDDDG) also applies. Without your consent, this is only permitted where it is strictly necessary for us to provide a digital service that you have expressly requested (§ 25(2) no. 2 TDDDG); in all other cases your consent is required (§ 25(1) TDDDG). In the following sections, we state the relevant legal basis for each processing operation.
Our website is hosted by an external service provider: [name and address of the hosting provider]. The servers are located in [country of server location – to be confirmed]. The hosting provider processes the personal data arising on the website – in particular the server log files and the form entries stored in the website database – solely on our behalf and in accordance with our instructions. We have concluded a data processing agreement with the provider pursuant to Art. 28 GDPR [to be confirmed]. We use a professional hosting provider in our legitimate interest in a secure, fast and reliable provision of our website (Art. 6(1)(f) GDPR).
Each time our website is accessed, the web server automatically records information transmitted by your browser and stores it in server log files:
We need this data to deliver the website, to ensure its stability and security and to detect and defend against errors and attacks. The legal basis is Art. 6(1)(f) GDPR; our legitimate interest lies in the technically error-free and secure provision of the website. This data is not combined with other data sources or analysed for marketing purposes.
The log files are deleted automatically after [14 days – to be confirmed]. This does not apply to data whose further retention is required for evidence purposes, for example to investigate a specific security incident; such data is retained until the incident has been finally resolved.
For security reasons and to protect the transmission of confidential content, such as your inquiries via the contact form, this website uses SSL/TLS encryption. You can recognise an encrypted connection by “https://” in your browser’s address bar. This protects the data you send to us from access by third parties while in transit. Nevertheless, no one can guarantee complete security of data transmission over the internet; you are therefore free to send us information by other means at any time, for example by telephone.
The fonts used on this website are stored on our web server and loaded from there. No connection to Google servers (Google Fonts) or to other providers is established in the process. The same applies to the 3D graphics library Three.js, which we use to create three-dimensional visualisations: it is also loaded from our own server.
Cookies are small text files that your browser stores on your device. Your browser’s session storage (sessionStorage) works in a similar way; its content is deleted automatically when you close the browser tab.
We do not use any analytics, advertising or tracking cookies, and no third-party cookies are set when you visit our website. Only the following technically necessary storage is used:
The fleet explorer does not store any information on your device.
The legal basis for the storage described above is § 25(2) no. 2 TDDDG, as it is strictly necessary to provide the functions you use. Insofar as personal data is processed in this context, this is based on Art. 6(1)(f) GDPR; our legitimate interest lies in a functional and user-friendly website.
If you actively load a YouTube video or a Google Maps map, Google may use its own cookies or similar technologies (section 9).
You can set your browser to allow cookies only in individual cases, to refuse them in general or to delete them when you close the browser, and you can delete stored cookies and data in the browser storage at any time. If cookies are deactivated, individual functions of the website may be limited.
You can use our contact form for inquiries. It is provided with the WordPress plugin Elementor Pro and processed on our server. We process the following information:
When the form is submitted, the date and time, the page on which you submitted the form, your IP address and information about your browser (user agent) are also recorded [to be confirmed: default setting of Elementor Pro, can be switched off in the form settings]. We use this technical information solely to be able to detect and trace misuse of the form.
Your information is sent by e-mail to info@neeb-krane.de and is also stored by the form plugin in our website database. We use it solely to process your inquiry and for follow-up questions, and we do not pass it on to third parties without your consent.
The legal basis is Art. 6(1)(b) GDPR where your inquiry relates to the performance of a contract or is necessary for the implementation of pre-contractual measures, for example a request for a quotation. Otherwise, the processing is based on our legitimate interest in effectively handling the inquiries addressed to us (Art. 6(1)(f) GDPR); this also applies to the technical information mentioned above.
We delete the form entries stored in the website database after [six months – to be confirmed]. We delete the inquiry sent to us by e-mail as soon as the purpose of storage no longer applies – for example once your inquiry has been fully dealt with – or when you ask us to delete it, unless statutory retention obligations prevent this (section 11).
If you contact us by e-mail or telephone, we process the information you provide (e.g. name, contact details and the content of your request) in order to deal with your inquiry. This also applies if you write to one of the direct e-mail addresses of our contact persons published on our contact page. The legal basis is Art. 6(1)(b) GDPR where your inquiry relates to a contract or pre-contractual measures, and otherwise Art. 6(1)(f) GDPR. We delete the data as soon as the purpose of storage no longer applies or when you ask us to delete it, unless statutory retention obligations prevent this (section 11).
We accept applications by e-mail to b.klee@neeb-krane.de. We process the data you send us – in particular your contact details, CV, cover letter, references and certificates, and your salary expectations – solely for the purpose of carrying out the application process. Only the persons in our company who are involved in the selection process have access to it. The same applies if you send us information about an application via the contact form.
The legal basis is Art. 6(1)(b) GDPR (pre-contractual measures with a view to establishing an employment relationship). In addition, the national provisions on employee data protection adopted on the basis of Art. 88 GDPR apply, in particular § 26 of the German Federal Data Protection Act (BDSG), insofar as they are applicable.
If you are hired, we will continue to process your data for the purpose of carrying out the employment relationship. Otherwise, we will delete your application documents six months after the end of the application process. Retention until then serves to defend against possible legal claims, in particular under the German General Equal Treatment Act (AGG); the legal basis for this is Art. 6(1)(f) GDPR. We will only store your data for longer, for example in order to consider you for future vacancies (talent pool), with your consent (Art. 6(1)(a) GDPR), which you can withdraw at any time with effect for the future.
Our website assistant automatically answers questions about our fleet, our services and our news. When you type a question or click on one of the suggestions, the text is sent together with the selected language to our own web server, where it is matched exclusively against the content of this website (fleet, pages and news). No external AI service or other third-party provider is used for this purpose.
Your questions are not stored in a database and are not analysed for any other purpose. However, as a question is technically transmitted as part of the requested address (URL), it may appear together with your IP address in the server log files; it is then deleted together with them (section 4). The conversation history is stored only in your browser’s sessionStorage (section 5).
Please do not enter any personal data in the assistant, such as names, telephone numbers or e-mail addresses. For specific inquiries, please use the contact form or our other contact channels.
The legal basis is Art. 6(1)(f) GDPR; our legitimate interest lies in giving you quick access to the information on our website.
Our website assistant contains a link to write to us via WhatsApp. It is a simple link; no data is transmitted to WhatsApp when you visit our website. WhatsApp (the app or WhatsApp Web) only opens when you click the link. From that point on, WhatsApp Ireland Limited, Merrion Road, Dublin 4, D04 X2K5, Ireland, processes your data (e.g. IP address, telephone number and usage data) under its own responsibility in accordance with its privacy policy: https://www.whatsapp.com/legal/privacy-policy-eea. In this context, data may be transferred to Meta Platforms, Inc. in the USA; the company is certified under the EU-U.S. Data Privacy Framework. The same applies to WhatsApp links elsewhere on the website, for example in the website assistant.
If you write to us via WhatsApp, we process your telephone number, your profile name and the content of your messages in order to deal with your request. The legal basis is Art. 6(1)(b) GDPR where a contract or pre-contractual measures are concerned, and otherwise Art. 6(1)(f) GDPR (legitimate interest in responding to inquiries via the channel you have chosen).
On some pages we embed videos from the YouTube platform. The provider is Google Ireland Limited, Gordon House, Barrow Street, Dublin 4, Ireland (“Google”). We use the privacy-enhanced mode (youtube-nocookie.com) and a two-click solution: at first, only a placeholder loaded from our own server is displayed, and no connection to YouTube exists yet. The video is only retrieved from YouTube’s servers when you click “Load video”.
In this case, data such as your IP address, the address of the page visited and technical information about your browser and device are transmitted to Google. YouTube may also store or read cookies or similar technologies (e.g. local storage) on your device. If you are logged in to a Google account, Google may associate the retrieval with your account. Google may also transfer data to the USA; Google LLC is certified under the EU-U.S. Data Privacy Framework.
The legal basis is the consent you give by clicking “Load video” (Art. 6(1)(a) GDPR and § 25(1) TDDDG). Your consent applies only to the respective retrieval and is not stored: each time a page is opened again, a video is only loaded after another click. You can withdraw your consent at any time with effect for the future by not loading any further videos and deleting the cookies stored by YouTube in your browser. Further information can be found in Google’s privacy policy: https://policies.google.com/privacy.
On our contact page you can display our location on a Google Maps map. The provider is also Google. The map is only loaded when you click the corresponding button (two-click solution); before that, no connection to Google is established. In addition, the website contains a simple link to Google Maps, which only opens Google Maps when you click it.
If you load the map or click the link, data such as your IP address, the address of the page visited and technical information about your browser and device are transmitted to Google. Google may use cookies or similar technologies and may also transfer data to the USA; Google LLC is certified under the EU-U.S. Data Privacy Framework. The legal basis for loading the map is the consent you give by clicking (Art. 6(1)(a) GDPR and § 25(1) TDDDG). It applies only to the respective retrieval and can be withdrawn at any time with effect for the future by not loading the map again and deleting the cookies stored by Google. Once you have opened Google Maps via the link, Google’s privacy policy applies: https://policies.google.com/privacy.
We link to our profiles on Facebook and Instagram. These are simple links, not so-called social media plugins; no data is transmitted to these networks when you visit our website. Only when you follow a link are you taken to the pages of Meta Platforms Ireland Limited, Merrion Road, Dublin 4, D04 X2K5, Ireland, where Meta’s privacy policies apply: https://www.facebook.com/privacy/policy/ (Facebook) and https://privacycenter.instagram.com/policy (Instagram). The same applies to links to the websites of other providers, such as our partners: once you click on such a link, the respective provider alone is responsible for the data processing.
Within our company, only those persons who need your data to deal with your request have access to it. External recipients are:
When YouTube, Google Maps and WhatsApp are used, data may be transferred to the USA. For transfers to companies certified under the EU-U.S. Data Privacy Framework, the European Commission has found an adequate level of data protection (adequacy decision under Art. 45 GDPR of 10 July 2023). Google LLC and Meta Platforms, Inc. are certified accordingly.
We only store personal data for as long as is necessary for the respective purpose; the specific periods are stated in the sections above. Once the purpose no longer applies, we delete the data unless statutory retention obligations prevent this. Such obligations exist in particular under commercial and tax law (§ 257 of the German Commercial Code – HGB, § 147 of the German Fiscal Code – AO), with periods of generally six to ten years, for example for business correspondence if an inquiry leads to an order. In these cases, we restrict the processing and delete the data once the period has expired (Art. 6(1)(c) GDPR).
You are under no statutory or contractual obligation to provide us with personal data. However, without the information marked as mandatory in the contact form we cannot process your inquiry, and without application documents we cannot consider your application. The processing of access data in accordance with section 4 is technically necessary for using the website.
Subject to the statutory requirements, you have the following rights:
To exercise your rights, an informal message to the contact details given in section 2 is sufficient, e.g. by e-mail to info@neeb-krane.de.
Right to lodge a complaint: Without prejudice to any other remedy, you have the right to lodge a complaint with a data protection supervisory authority, in particular in the Member State of your habitual residence, your place of work or the place of the alleged infringement (Art. 77 GDPR). The supervisory authority responsible for us is the Landesbeauftragte für Datenschutz und Informationsfreiheit Nordrhein-Westfalen (LDI NRW – State Commissioner for Data Protection and Freedom of Information of North Rhine-Westphalia), Kavalleriestraße 2-4, 40213 Düsseldorf, Germany, https://www.ldi.nrw.de.
Where we process your personal data on the basis of Art. 6(1)(f) GDPR (legitimate interest), you have the right to object to this processing at any time on grounds relating to your particular situation. We will then no longer process your data unless we can demonstrate compelling legitimate grounds for the processing which override your interests, rights and freedoms, or the processing serves the establishment, exercise or defence of legal claims.
Your objection is not subject to any formal requirements; please address it preferably to the contact details given in section 2.
We do not carry out automated decision-making, including profiling, within the meaning of Art. 22 GDPR. The answers given by the website assistant are not such decisions either, but non-binding references to content on our website.
We will update this privacy policy if our website, the services we use or the legal requirements change. The version currently published on this page applies.
